Mumbai Court orders guy to wed the woman he allegedly raped

According to the court, the accused and the pregnant 22-year-old were in a consensual relationship before the guy began to ignore her after learning of her pregnancy. This led to the filing of a rape and infidelity case.

The man was detained in February 2020 due to a report the woman made to the Mumbai Police. She complained they had been in a relationship since 2018 and that their families were aware of the same and had not objected to it.

In 2019, the lady learned she was pregnant and told the defendant; nonetheless, he began to ignore her. The woman fled home because she did not want to tell her family members she was pregnant. She gave birth to a child in a metropolitan hospital on January 27, 2020.

The mother left the infant in front of a building on January 30. She was then the subject of a separate FIR for abandoning the kid.

This "may be a probable explanation why she is escaping from the course of justice," Justice Dangre said in her ruling.

The accused gave the High Court assurances that he was prepared to wed the woman and acknowledge the fatherhood of the kid.

The kid, who was admitted to a child care facility, has already been placed in adoption, according to information provided to the court by the police, who said the lady was untraceable.

According to the High Court, the victim was a major and had already declared that the relationship was consensual when the event was reported.

The judge stated, "I believe it suitable to release the applicant on bail subject to compliance that if the victim is found quickly, let's say within a year, he must wed her. However, he shall not be bound by the statement for more than a year," it said.
The court granted bail to the man on a bond of ₹ 25,000.

The Bombay High Court granted a 26-year-old man who was detained in a rape case bail, but with the requirement that he marries the victim, who is presently untraceable, if she is discovered within a year.
But according to the ruling issued on October 12 by a single bench of Justice Bharati Dangre, the guy would not be subject to this requirement for more than a year.
